II-/ General conditions of sale
You are offered online Gift Vouchers to order with payment obligation.
We invite you to carefully read the entirety of these General Conditions of Sale which define the terms and conditions under which Vignette Alsace (La Vignette) Sarl sells its Gift Vouchers.
These General Conditions of Sale therefore only apply to orders for Gift Vouchers placed on the Site www.vignettealsace.com, directly by telephone: +33 (0)3 89 73 00 09 or at the establishment’s reception.
These conditions apply to the exclusion of all other conditions, in particular those in force for in-store sales.
These General Conditions of Sale are valid from January 1, 2015. They cancel and replace from this date, all previous versions of these conditions and prevail over all other general conditions of the Customer.
Vignette Alsace (La Vignette) Sarl reserves the right to modify these General Conditions at any time, without notice, it being understood that such modifications will be inapplicable to orders previously accepted and confirmed by Vignette Alsace (La Vignette).
Any Customer declares to have the legal capacity in accordance with article 1124 of the Civil Code to contract and use the Site in accordance with the General Conditions of Sale and use of the Site.

2.1: In the event that you are not the beneficiary of the Gift Voucher, you are invited to bring to the attention of the beneficiary the conditions set out below.

2.3: Only the presentation of the original Gift Voucher received by post or printed from the email entitles you to a service.

2.5: The Gift Box is valid according to the dates and days of the week specified on the Gift Voucher.
2.6: The photographs presented in the Gift Box are not contractual. Any partial or complete reproduction is prohibited.
2.7: Except online booking, delivery of the service will take place after the establishment has verified the validity of the Gift Voucher and full payment thereof. This check involves validation of the Gift Voucher number by the establishment to verify its effective activation.
ARTICLE 3: PRICE AND CONDITIONS OFPAYMENT

When purchasing a Gift Voucher, under the terms of article L.121-21 of the Consumer Code, you have a period of 14 clear days (from the date of receipt of the product) to exercise your right of withdrawal without having to provide reasons or pay penalties, with the exception of return costs.
A simple cancellation email (boooking@vignettealsace.com) is enough for us to cancel your Gift Voucher.
Return costs will remain your responsibility. Only Gift Boxes and Gift Vouchers returned on time and in perfect condition (Gift Boxes returned without the Gift Voucher present, damaged, soiled, will not be returned) can be refunded.

Any return made in accordance with the conditions of this article will give rise to a refund of the totality of the sums paid (with the exception of express delivery costs) at the latest within fourteen days from receipt of the Gift Box in perfect condition, by check or bank transfer, which you declare to accept without reservation.
ARTICLE 5: PROOF OF ORDERS/ARCHIVING
You are expressly informed that, unless there is a manifest error for which you provide proof, the data stored in the Vignette Alsace (La Vignette) Sarl databases have probative force regarding orders placed.
Data on computer or electronic media stored regularly constitute admissible and enforceable evidence under the same terms and with the same probative force as any document received and kept in writing.
ARTICLE 6: DELIVERY
Article 6.1: Availability of Gift Vouchers

The Boxes or Gift Vouchers will be delivered to you at the address you indicated when entering your order. The responsibility of L’Vignette Alsace (La Vignette) Sarl cannot therefore be held liable in any way whatsoever in the event of your absence during delivery or in the event of an input error on your part. , when placing the order. ARTICLE 7: VALIDITY DURATION OF GIFT BOXES

ARTICLE 9: – CONFIDENTIALITY OF DATA
The information requested from the Customer is necessary to process the Order.
In the event that the Customer agrees to communicate individual personal data, he has an individual right of access, withdrawal and rectification of this data under the conditions provided for by law no. 78-17 of 6 January 1978 relating to computing, files and freedoms. ARTICLE 10: FORTUITIVE EVENT – FORCE MAJEURE

ARTICLE 15: APPLICABLE LAW
The law governing these General Conditions of Sale and the contract concluded on the occasion of an order for a Gift Box or Gift Voucher, is French law for all disputes relating, in particular, to their validity, their interpretation, their execution or their termination.
ARTICLE 16: COMPETENT JURISDICTION (RESOLUTION OF DISPUTES)
The competent court in the event of a dispute will be the Paris Commercial Court in the case of a dispute between traders and similar persons (companies, branches, etc.) or that of the defendant’s place of residence or, at the plaintiff’s choice, of the actual place of delivery of the Gift Box in other cases.
